Correction and Retraction

PUBLICATION ETHICS & INTEGRITY

Correction and Retraction Policy

UIR Law Review (UIRLRev) is committed to maintaining the accuracy, transparency, and integrity of the scholarly record in legal scholarship. This policy describes how the journal assesses and addresses significant errors, reliability concerns, and ethical issues affecting published articles.

UIR LAW REVIEW | CORRECTION & RETRACTION
OUR COMMITMENT

UIRLRev recognizes that the published scholarly record may occasionally require correction or formal editorial action. Concerns are assessed fairly and with appropriate confidentiality. Decisions are based on the available evidence, the significance of the issue, the reliability of the published work, and applicable publication ethics principles. Legal disagreement or an alternative interpretation of law does not, by itself, justify correction or retraction.

01

Purpose and Scope

This policy applies to articles published in UIR Law Review and covers post-publication corrections, retractions, and expressions of concern. It applies when authors, readers, reviewers, editors, institutions, or other relevant parties raise credible concerns about the accuracy, integrity, or ethical acceptability of a published article.

Issues may involve legal analysis, statutory interpretation, judicial decisions, research data, methodology, citations, authorship, publication ethics, or other matters relevant to the reliability of a published contribution.

The journal aims to correct the scholarly record when justified and to ensure that editorial decisions are proportionate, documented, and independent of commercial, personal, or other competing interests.

02

Corrections

A correction may be issued when a published article contains an error that can be amended without invalidating its principal findings, legal analysis, interpretations, or scholarly contribution.

CORRECTION TYPE 01

Minor or Non-Substantive Errors

Examples include typographical errors, incorrect author affiliations, metadata inaccuracies, or other mistakes that do not materially affect the meaning or reliability of the article. The journal determines whether a formal correction notice is necessary.

CORRECTION TYPE 02

Substantive Correction

Errors in research data, tables, figures, methods, references, citations, or legal authorities may require a formal correction if the article remains reliable after the error is addressed. The journal assesses whether the error materially affects the analysis, interpretation, or conclusions.

Correction notice: A correction notice should identify the affected article, describe the error and its correction, and explain any implications for the article's interpretation. Where technically feasible, the notice will be linked to the original article, and the online record will be updated transparently.
03

Retraction

Retraction may be considered when available evidence indicates that a published article is unreliable or that serious ethical or publication misconduct has occurred. Retraction is intended to correct the scholarly record, not to punish an author or suppress a legitimate legal argument.

Grounds for retraction may include, but are not limited to, the following:

01. Fabrication or falsification of research data, evidence, or results.
02. Plagiarism or substantial unattributed duplication of published work.
03. Serious errors that invalidate the principal findings, analysis, or conclusions.
04. Improper or unethical research practices that undermine the validity or legitimacy of the work.
05. Duplicate or redundant publication that materially compromises the scholarly record.
06. Evidence of manipulated peer review or other serious publication misconduct.
07. Unauthorized use of data, serious authorship-related misconduct, or other ethical violations that undermine publication integrity.
08. Material misrepresentation of legal sources, research evidence, or other information that makes the article substantially unreliable.

Retraction will be considered after an appropriate assessment of the available evidence. Where appropriate, the journal will seek explanations from the authors and may consult relevant institutions, independent experts, or other competent bodies. A difference of opinion concerning legal doctrine, statutory interpretation, or judicial reasoning is not, by itself, grounds for retraction.

04

Expression of Concern

UIRLRev may publish an expression of concern when credible indications of a potentially serious problem exist, but the available evidence is insufficient to reach a final decision, or an investigation remains unresolved.

Purpose of the Notice

An expression of concern alerts readers to an issue while further clarification or investigation is pursued. It does not, by itself, establish that misconduct has occurred. The journal may update the notice when additional evidence becomes available and a decision is reached.

05

Assessment and Editorial Procedure

Concerns about a published article should be submitted through the journal's official editorial contact channels. A report should identify the article, explain the concern clearly, and provide supporting information or evidence where available.

STAGE 01

Receipt and Initial Screening

The editorial team records the concern and assesses whether it is sufficiently specific and relevant to warrant further consideration.

STAGE 02

Evidence Assessment

The editor examines the available evidence and may request clarification, supporting documents, or an explanation from the authors or other relevant parties.

STAGE 03

Consultation, Where Necessary

For complex or serious matters, the journal may consult independent experts, the authors' institutions, or other appropriate bodies.

STAGE 04

Editorial Decision

Based on the evidence, the journal determines whether no action, a correction, an expression of concern, or a retraction is warranted.

STAGE 05

Publication and Record Maintenance

When a formal notice is issued, the journal aims to make it identifiable, accessible, and linked to the affected article where technically feasible. The decision and its rationale are documented internally.

Fairness and independence: The journal seeks input from relevant parties before making a decision when appropriate. An author's disagreement or failure to respond does not, by itself, determine the outcome. Editorial decisions are based on the evidence available and the nature of the concern.
06

Retraction Notices and Article Availability

When an article is retracted, UIRLRev aims to publish a clearly identifiable retraction notice explaining the reason for the action to the extent that it can appropriately be disclosed. The notice should identify the affected article and provide a transparent explanation of the basis for retraction.

REQUIREMENT 01

The retraction notice should be linked to the original article where technically feasible.

REQUIREMENT 02

The article's publication status should be clearly indicated in the online record.

REQUIREMENT 03

The original article should generally remain accessible with a clear retraction marking rather than being silently removed, unless legal, privacy, or other exceptional considerations justify a different approach.

REQUIREMENT 04

Relevant metadata and indexing services may be notified where appropriate and technically possible.

Preservation of the scholarly record: UIRLRev aims to avoid silently replacing or removing a published article in a way that obscures a substantive change to the scholarly record.
07

Responsibilities of Authors and Readers

AUTHOR RESPONSIBILITY

Authors

Authors are expected to notify the journal promptly if they discover a material error in their published work and to cooperate reasonably with an editorial assessment. They should provide relevant clarification or supporting information when requested.

READER RESPONSIBILITY

Readers and Concerned Parties

Readers and other concerned parties are encouraged to provide specific, evidence-based information and to avoid unsupported allegations or inappropriate disclosure of confidential information obtained during an editorial process.

EDITORIAL RESPONSIBILITY

Editorial Team

The editorial team is responsible for assessing concerns impartially, protecting confidential information where appropriate, documenting decisions, and taking action proportionate to the available evidence.

08

Confidentiality, Appeals, and Timeliness

UIRLRev handles reports and supporting information with appropriate confidentiality, subject to the requirements of a fair assessment, applicable law, and legitimate requests from relevant institutions. Information will be shared only as necessary to assess and address the concern.

Authors or other directly affected parties may submit a reasoned appeal if they believe an editorial decision was based on a factual error, an unfair procedure, or material evidence that was not considered. Where feasible, the appeal should be reviewed by an editor or an appropriate independent editorial representative who is not directly conflicted by the case.

The time required to resolve a case depends on its complexity, the availability of evidence, and the need for external consultation. The journal aims to handle cases without unnecessary delay but does not guarantee a fixed resolution period.

09

Ethical Framework

UIRLRev seeks to align its handling of corrections, retractions, and expressions of concern with recognized publication ethics principles, including guidance from the Committee on Publication Ethics (COPE), where applicable.

Editors may consult COPE guidance when evaluating specific cases. The application of any guidance will depend on the circumstances, available evidence, and applicable legal or institutional requirements.
