GERAKAN POLITIK PARTAI BURUH TAHUN 2021-2024 DALAM GUGATAN OMNIBUS LAW UU CIPTA KERJA DI MAHKAMAH KONSTITUSI TAHUN 2023

Abstract

This study discusses the political movement of the Labour Party in rejecting the 2023 Omnibus Law on Job Creation, focusing on its judicial review petition to the Constitutional Court. The Labour Party, which was re-established in 2021 by elements of the labour movement, emerged as a response to the enactment of the 2020 Omnibus Law on Job Creation. Therefore, opposition to this law is a mandate of the Labour Party’s ideological struggle. This study also examines the Labour Party’s political movement in its efforts to influence and change the policy of the Omnibus Law on Job Creation. This study uses a qualitative case study approach. This study employs the theoretical framework of pressure group theory, which includes political movement strategies such as establishing relationships with elite state actors within the framework of insider pressure-group politics, forming coalitions with other pressure groups, utilizing mass media, and pursuing legal or litigation channels. The findings indicate that, although it is a non-parliamentary political party, the Labour Party has managed to act as a strategic pressure group in influencing and changing the 2023 Omnibus Law on Job Creation policy, particularly in the labour cluster. Through a combination of political actions such as judicial review, collaboration with elite state actors, coalitions with labour and civil society organizations, and the use of media, the Labour Party succeeded in changing the labour the Omnibus Law on Job Creation particularly the labour cluster through a Constitutional Court decision. Litigation has become the Labour Party’s main political movement strategy to influence and change government policy.
